Refund Policy

This policy applies to the use of HSflow™ by businesses.

1. Scope

HSflow™ is supplied exclusively to entrepreneurs within the meaning of section 14 of the German Civil Code (BGB). There is therefore no statutory right of withdrawal; for details see Right of Withdrawal. This policy sets out the circumstances in which we will nevertheless refund amounts paid.

2. Annual licence

HSflow™ is invoiced as an annual licence. The licence fee covers the agreed term of twelve months.

A pro-rata refund of licence fees already paid is excluded where the term simply expires or the application is not used.

3. Cancellation before provision of access

If the customer cancels the contract in text form before access to HSflow™ has been provided, we will refund any payments already made in full within 14 days.

Once access has been provided, cancellation is no longer possible; section 2 applies.

4. Technical faults

If a technical fault prevents the customer from using HSflow™, we will restore access without undue delay or offer an alternative solution.

If the service ultimately cannot be provided, we will refund the licence fee attributable to the period of unavailability on a pro-rata basis. The customer’s statutory rights in respect of defects remain unaffected.

5. Termination for good cause

If the customer justifiably terminates the contract for good cause, we will refund the licence fee attributable to the period after the termination takes effect on a pro-rata basis.

6. Discretionary refunds in cases of hardship

In justified cases of hardship – for example insolvency, cessation of business or a substantial unforeseen loss of workforce – a partial refund or credit note may be granted at our discretion. Please submit a request in text form, together with supporting evidence, to: contact@dth-group.de

There is no legal entitlement to a discretionary refund.

7. Processing of refunds

Refunds are made by bank transfer to the account from which payment was made, or to a business account specified by the customer. Processing takes place within 14 days of the claim being confirmed in text form.

German law applies. The exclusive place of jurisdiction is Würzburg, Germany, to the extent permitted by law.
